Freedom of Information Requests

Accessing Your Medical Records

You have the right to request access to your medical record and personal information held by Mansfield District Hospital in accordance with the Freedom of Information Act 1982 (Vic) (FOI Act) and the Health Records Act 2001.

Your rights extend to obtaining copies of information, viewing information. You may also request an amendment to information that is incomplete, incorrect, misleading or out of date.

You can also request access to the medical information of another person with their written consent.

We consider each request in accordance with the FOI Act. As a result, some requested documents will be granted and some may be exempted. If documents you request are exempted we will advise as to the reason.

Examples include:
  • Documents containing personal information about other people
  • Documents containing information provided in confidence to Mansfield District Hospital
  • Internal working papers
  • Making a Request

    Applications must be made in accordance with the FOI Act. You will need to:

    • Download and complete a written application in the FOI Application Form appication form.
    • Provide a clear photocopy of identification with your application. Your identification must contain a photograph of you and your signature. Your passport or drivers licence are good documents to use.
    • Provide written signed authority for release of information if you are requesting access to another person’s information.
    • Pay a non-refundable application fee which is currently $31.80.
  • Cost

    Apart from the application fee noted above, FOI access fees are charged in accordance with the FOI Act. Payment is to be made by cash or creditcard to Mansfield District Hospital.

    Current charges are:

    • Search time - $22.20 per hour
    • Paper records - $0.20 per single side black and white photocopy
    • Postage - the cost of postage by Registered Mail

    We respect your right to access your medical records, and do not want costs to be a barrier to you exercising your rights. If you are concerned about costs, please discuss this with us, and in certain circumstances fees may be waived.

    Once we receive your request
    • You will receive acknowledgement within fourteen (14) days.
    • You may be contacted for further information.
    • A formal decision letter will be provided within thirty (30) days from receipt of request, unless an extension has been permitted under the FOI Act.
